1. Parties and acceptance
This document is a public offer (public oferta) made under the Civil Code of the Republic of Azerbaijan by the individual entrepreneur (fərdi sahibkar) identified in the service provider block above, who trades under the name JustHostin and operates the website justhostin.com and the client area at https://clients.justhostin.com. The provider's name, taxpayer identification number (VÖEN), address and e-mail are given above, as required by the Law of the Republic of Azerbaijan "On Electronic Commerce".
It sets out the terms on which we supply hosting, server and domain-related services to any person or company who orders them ("you", "the customer"). You accept this offer, and it becomes a binding agreement between you and JustHostin, when you do any of the following: place an order, create an account, tick the acceptance box at checkout, or pay an invoice in the client area. A contract concluded in this way is a contract in electronic form and has the same force as a written contract. If you do not agree with these terms, do not use the website or order a service.
These terms apply to every visitor of the website and every customer, together with the Acceptable Use Policy, the Privacy Policy, the Refund Policy and the Service Level Agreement, each of which is incorporated by reference.
2. Who may order
By ordering, you confirm that you are at least 18 years old or otherwise have full legal capacity, that you have the authority to bind any company on whose behalf you order, and that the information you give us is accurate and complete.
Where you are a natural person ordering for purposes unrelated to a business or profession, you are a consumer and the Law of the Republic of Azerbaijan "On Protection of Consumer Rights" applies to you in addition to these terms. Where these terms would limit a right that law gives you, the law prevails.
3. Services
JustHostin provides cPanel shared hosting (including the e-mail service bundled with hosting plans), virtual private servers (VPS), VPS configured for 1C:Enterprise (1C VPS), domain name registration and transfer, and related add-ons. The features, resource limits and price of each plan are described on the corresponding page of the website and shown again at checkout before you pay. The description at checkout is the one that forms part of the contract.
Our services run on data-centre infrastructure and software platforms operated by third-party providers, branded and supported by JustHostin. We select those providers with care, but maintenance or outages on their side may occur outside our direct control; Section 13 describes what we commit to.
We may modify, replace or discontinue a plan. If a change materially reduces a service you have already paid for, we will tell you at least 30 days in advance and, if you do not wish to continue, refund the unused part of the period you paid for.
4. Account
To order a service you must create an account in the client area and keep the contact and billing details in it accurate and current. Each account has one person or entity responsible for it, even where several people use the underlying services. You are responsible for keeping your account credentials confidential, for every action taken under your account, and for notifying us without undue delay at info@justhostin.com if you believe your credentials have been compromised. We are not responsible for unauthorised access that results from credentials you failed to protect.
5. Prices, orders and payment
The price of a service is the price displayed at the time you place the order. Prices are displayed in US dollars. Where a payment method collects payment in Azerbaijani manat, the amount is converted at the rate shown at checkout before you confirm. Any applicable taxes are shown at checkout based on your billing details. Accepted payment methods are those offered at checkout in the client area.
All services are paid in advance for the billing cycle you select (monthly, quarterly, yearly or another period shown at order time); an invoice for each cycle is issued before the period it covers. A contract for a specific service is concluded when we accept your order by activating the service. We may decline an order, for example where we cannot verify the payment or the details you gave us; anything you already paid for a declined order is refunded.
If an invoice is not paid by its due date, we send a reminder through the client area and by e-mail. A service with an unpaid invoice may be suspended 7 days after the due date and terminated 30 days after the due date. Data belonging to a terminated service is kept for 14 days after termination and then deleted permanently, as described in Section 14.
6. Term, renewal and cancellation
Services renew automatically at the end of each billing cycle unless you cancel them, or turn auto-renew off, in the client area before the renewal date. You may cancel a service at any time from the client area; it stays active until the end of the period already paid for, and no fee is charged for cancelling. Domain renewals, once processed with the registry, cannot be reversed and are non-refundable.
7. Money-back guarantee and refunds
New shared-hosting plans come with a 30-day money-back guarantee running from the date of your first order of that plan. Domain registrations, transfers and renewals, VPS and 1C VPS services, add-ons and renewals of an existing service are excluded from the guarantee. How to request a refund, and how and when refunds are paid, is set out in the Refund Policy. Nothing in this section limits a consumer's statutory rights.
8. Acceptable use and resource usage
Your use of any JustHostin service must comply with our Acceptable Use Policy. In particular you must not use the services for activity that is illegal under the law of the Republic of Azerbaijan or of the country you operate from; to distribute malware or other harmful code; for phishing, fraud or scams; to send spam or unsolicited bulk e-mail; to host content that infringes intellectual property rights; or for anything that disrupts our network or the availability of services to other customers.
Server resources must be used responsibly. Unless a plan explicitly allows it, cryptocurrency mining, automated abusive scripts or processes, and CPU, memory, disk or inode usage that degrades the service for other customers are prohibited. We may limit, suspend or terminate an account that negatively affects the performance of a server. A breach of the Acceptable Use Policy is a breach of this offer and may lead to suspension or termination as described in Section 14.
9. Shared hosting specifics
Shared hosting plans run on shared infrastructure and are subject to fair use of CPU, RAM, inodes and other resources so that no single account degrades the service for others. Shared hosting accounts may not be used as a substitute for off-site backup storage or as a general file-sharing or media-streaming service. Outgoing e-mail is subject to sending limits that protect the shared mail infrastructure from abuse and protect deliverability for all customers.
10. VPS and 1C VPS specifics
On a VPS or 1C VPS you administer the operating system, the applications and any software you install; you are responsible for their configuration, updates, licences and security. 1C:Enterprise software is licensed to you by its publisher or reseller, not by JustHostin, unless a licence is expressly included in the plan. We may reboot, isolate or suspend a VPS without prior notice where necessary to address abuse originating from it, a security incident, or a risk to our network or other customers, and will restore access once the issue is resolved.
11. Domains
You are responsible for the accuracy of the registrant data submitted for any domain you register or transfer through us. Domain registrations are subject to the applicable ICANN and registry policies for the extension concerned, which take precedence over these terms in the event of a conflict. A domain must generally have been registered or transferred at least 60 days earlier before it becomes eligible for a further transfer. Renewal grace periods, and the consequences of a missed renewal, vary by registry and extension; a domain that is not renewed in time may be lost or may cost more to recover.
12. Backups and your data
We run daily backups of shared hosting plans as described on the Web Hosting page. Backups are provided as a convenience: we do not guarantee that any particular backup exists or can be restored, and you must keep your own independent copies of anything you cannot afford to lose. For VPS and 1C VPS we do not back up or restore data unless a backup service has been purchased separately; you are responsible for backing up a self-administered server. You remain the owner of the content, applications and data you host with us.
13. Availability and maintenance
We aim to provide reliable, stable services. Shared hosting is covered by the uptime commitment of 99.9% set out in our Service Level Agreement, together with the service credits described there; other services are provided with reasonable care but without a guaranteed uptime figure. We announce planned maintenance in the client area or by e-mail in advance where practicable and perform it outside peak hours where possible. Emergency maintenance, security incidents, network disruptions and events outside our control may cause interruptions without notice.
14. Suspension and termination
We may suspend or terminate a service where an invoice remains unpaid as described in Section 5; where you breach this offer or the Acceptable Use Policy; where we receive a substantiated abuse report or a lawful order from a competent authority; or where this is necessary to protect our network, other customers or the service itself. We give notice before suspending where the circumstances allow it; in cases of serious violation, or where delay would cause harm, suspension may be immediate.
After a service is terminated, its data is retained for 14 days and then deleted permanently; export anything you need before that period ends. Termination for your breach does not entitle you to a refund of fees already paid.
15. Personal data
We process the personal data you give us in accordance with our Privacy Policy and the Law of the Republic of Azerbaijan "On Personal Data". The client area, ordering and invoicing are provided through the Upmind platform, which processes your account data on our behalf. Where you store personal data of third parties on our services, you are the controller of that data and are responsible for having a lawful basis to process it.
16. Intellectual property
The website, its content, and the JustHostin name and branding are our property or that of our licensors and may not be copied or used without permission. You retain all rights to the content, applications and data you host with us, and you are solely responsible for ensuring you have the rights necessary to host, use and distribute them.
17. Warranties and limitation of liability
Except for the express commitments in these terms and the Service Level Agreement, services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we are not liable for loss of data that you could have avoided by keeping the backups described in Section 12, loss of profit or revenue, business interruption, or indirect or consequential loss, and our total liability arising out of or relating to this offer is limited to the fees you paid for the affected service in the 12 months preceding the event giving rise to the claim. Nothing in this section limits liability for intentional wrongdoing or gross negligence, or any right you have as a consumer under mandatory Azerbaijani law that cannot lawfully be excluded.
18. Your responsibility for your use
You are responsible for the content you host and for the activity conducted through your services. If a third party or an authority brings a claim against us because of your content, your misuse of the services or your breach of these terms, you will compensate us for the resulting damage, costs and reasonable legal expenses. For a consumer, this obligation is limited to the loss caused by the consumer's own breach, as provided by law.
19. Force majeure
Neither party is liable for a failure or delay in performance caused by events beyond its reasonable control, including natural disaster, war, act of government, internet or power infrastructure failure, or a similarly extraordinary event, for as long as that event continues. If such an event prevents us from providing a service for more than 30 consecutive days, either party may cancel the affected service and we refund the unused part of the prepaid period.
20. Notices
We send notices to the e-mail address on your account and through the client area; a notice is deemed received on the next business day after it is sent. You may send notices to us at info@justhostin.com. Keep your contact details current, because notices sent to an out-of-date address are still considered delivered.
21. Governing law and disputes
This offer is governed by the law of the Republic of Azerbaijan. If a dispute arises, the parties will first attempt to resolve it through direct negotiation: send a written complaint to info@justhostin.com and we will reply within 15 working days. If that fails, the dispute is subject to the jurisdiction of the competent courts of the Republic of Azerbaijan. Consumers may also apply to the State Service for Antimonopoly and Consumer Market Control under the Ministry of Economy of the Republic of Azerbaijan for assistance regarding consumer rights.
22. Changes to this offer
We may update this offer from time to time. Changes take effect when published on the website. Material changes are announced at least 14 days in advance by e-mail or in the client area; if you do not accept a material change, you may cancel the affected service before the change takes effect and we refund the unused part of the prepaid period. Continued use of the services after a change takes effect constitutes acceptance of the updated offer. The version you accepted at checkout is recorded in the client area.

This document is published in Azerbaijani, English and Russian. If the versions differ, the Azerbaijani text prevails, as required for a public offer governed by the law of the Republic of Azerbaijan.
